In a proceeding pursuant to CFLR article 78 to compel the respondent William Steinhaus to add the petitioner Sharon Fleury to the County of Dutchess payroll as Deputy Comptroller of Dutchess County, the petitioners appeal from a judgment of the Supreme Court, Dutchess County (Brands, J.), dated April 9, 2007, which denied the petition and dismissed the proceeding.

Ordered that the appeal is dismissed as academic, without costs or disbursements.
