At the station of Tabor, where the accident happened, the railroad track was not fenced, and there was no cattle-guard where the public highway crosses the railroad, to prevent cattle from passing upon the track. Tabor is not an incorporated town or village, and it was not laid out into lots or blocks. The place consisted of a post-office, a grain elevator, one dwelling and several corn-cribs.
