MEMORANDUM OPINION AND ORDER

BAUER, District Judge.

This cause comes before the Court on the motion of the Government to dismiss this petition for a writ of habeas corpus.

Petitioner Andrea Lieggi was born in Vola Debari, Italy on October 4, 1947. On April 25, 1963, when 16 years old, he came to the United States as a lawful immigrant to join his father, Guisseppi, a resident and citizen of the United States.
