David Lee Ewing, found not guilty of murder by reason of mental illness, was ordered committed to the custody of the Director of the Division of Mental Diseases and kept for care and treatment in a state mental hospital. While confined to State Hospital No. 1 at Fulton under this order Ewing was charged under § 202.435, 1 with unlawfully and feloniously removing himself from the lawful restraint of State Hospital No. 1.
