The plaintiff’s contention was that he had been employed by the defendant to “negotiate the sale” of property owned by the defendant; that he had obtained a purchaser therefor at a stated price; and that the defendant had accepted this purchaser, one Wheeler, and had entered into a written agreement with him for the sale of the property at that price.
