This action was commenced by tbe plaintiff in error as plaintiff against tbe defendant in error as defendant, to recover upon a claim against tbe estate of 0. B. Howell, deceased, of wbicb tbe defendant, Hoy Harsba, is administrator.

Tbe substantial averments of tbe plaintiff’s petition are: That between tbe 17th day of November, 1922, and the 28tb day of April, 1923, tbe deceased, O. B. Howell, sold and transferred to tbe plaintiff 52 conditional sales contract notes and guaranteed tbe payment thereof at maturity; that said notes were due and payable in monthly…
