I am inclined to the' opinion that the referee erred in not permitting the plaintiff to show that the making of advances and temporary loans, for the accommodation of customers, was incidental to the transportation business generally, at Albany. If it tended to prove that the loan in question was incidental to the purposes for which the corporation was created, it was certainly admissible. But without deciding this question, I think it is better to determine this cause upon the facts which were in evidence, as they presented questions of great importance which will…
