Suit filed September 26, 1899, by-appellant against N. B. Clark and lone Clark and Lewis and Mollie Clark, on two promissory notes, executed by N. B. and lone, October 1, 1892, to Lewis Clark for $200 each, due respectively at three and four years, bearing 10 per cent per annum, and providing for payment of 10 per cent attorney’s fees, each reciting that it was given as part consideration of a lot in the city of Waco, retaining vendor’s lien to secure payment.
