— Appeal from an order of the Supreme Court at Special Term, entered July 25, 1978 in Albany County, which denied defendant’s motion to dismiss the complaint and granted plaintiff’s motion for temporary alimony and counsel fees. Plaintiff brought an action for divorce against defendant in New York State on the grounds of adultery, abandonment and cruel and inhuman treatment.
