INTRODUCTION

Kevin Milliken appeals from the Workers’ Compensation Court review panel’s affirmance of the workers’ compensation trial court’s award of benefits to Milliken. Specifically, Milliken claims that he was improperly denied an award of a waiting-time penalty and associated attorney fees sought pursuant to Neb. Rev. Stat. § 48-125 (Reissue 2004). The denial of a waiting-time penalty and attorney fees was based on the trial court’s finding that there existed a reasonable controversy regarding the occurrence of an accident.
