In this neglect proceeding (Family Ct Act art 10) the petitioner Commissioner of Social Services of the City of New York moves by notice of motion dated January 29, 1990 pursuant to Family Court Act § 1061 for an order vacating this court’s prior directive of August 2, 1989 that a termination of parental rights proceeding be filed by the Commissioner on the child’s behalf.
