On September 15, 1930, W. J. Vogt, as “Agent for Owners”, entered into a written agreement to sell to James J. Brady, the defendant, certain premises in Delaware County for the consideration of $13,500, of. which $500 was paid to the agent at the time, and the balance was to be paid in forty days by assuming certain encumbrances and paying a further sum in money at that time. The agreement contained the following clause: “It is understood that this sale is made subject to the written' approval of the owner, which must be obtained within two days,” and provided that time…
