Action in the district court for Stearns county to recover $10,-000 damages for personal injuries. The case was tried before Searle, J., and a jury, which rendered a verdict in favor of plaintiff for $4,000. From an order denying a motion for judgment notwithstanding the verdict or for a new trial, defendant appealed.

This action was brought to recover for personal injuries alleged to have been sustained by the plaintiff through the negligence of the defendant, the particular negligence complained of being the careless and reckless running of a passenger train at an excessive rate of speed, without warning of the coming thereof by ringing the bell or blowing the whistle, as the train approached a street crossing in the village of Sauk Center.

The crossing was in the outskirts on the south side of the village, and there were no buildings near the track to obstruct the *121view. The station at which the train…
