In a proceeding pursuant to CPLR article 78 to compel the respondent North Bellmore Union Free School District to pay the petitioner his salary pending a hearing pursuant to Education Law § 3020-a, the petitioner appeals from a judgment of the Supreme Court, Nassau County (Robbins, J.), entered June 28, 1985, which dismissed the proceeding.

Ordered that the judgment is modified, on the law and the facts, by deleting the provision thereof which dismissed that branch of the petition which demanded salary and benefits for the period from August 11, 1985 to December 15, 1985, and the claim for…
