This case is before the Court upon appeal of Paul Farmer from the August 28, 1997, final order of the Circuit Court of Raleigh County, West Virginia,1 wherein the lower court set aside its September 26, 1996, order appointing counsel to represent the Appellant and dismissed the Appellant’s pro se petition for habeas.
