The plaintiffs in error, hereinafter referred to as the defendants, were jointly charged with Rudolph Wiese, with maintaining a public nuisance, and were jointly tried; Otto Wiese, Emil Wiese, and Leo Wiese were convicted and each sentenced to pay a fine of $200 and costs, and to be imprisoned in the county jail for sixty days. From which sentence and judgment defendants have appealed to this court.
The testimony on behalf of the state tends to show that the defendants were farmers living in Canadian county, about ten miles from El Reno; the defendants were in the habit of having play parties…
