This was an action to recover damages from the defendants for, their alleged!.' negligence, by reason of which the plaintiffs’ intestate 'received iñjjuries which caused his death. The' defendants, as it appears, were contractors, engaged in- erecting an addition to a large building in the city of Hew York. Robertson was a bricklayer in their employ.
