Huston, J.

Levi Feay, brought an action for money had and received against George Decamp, to recover back money paid on an article of agreement for the sale of a tract of land, on the ground that the contract was rescinded. The defendant, Decamp, demurred to the evidence, which was partly written, and partly parol. The only difficulty arose, perhaps, from the manner in which the evidence was brought before the Court of Common Pleas. In 1816, Levi Feay, had brought an action of covenant against Decamp, in which he insisted on the contract, and contended…
