Daniel Goodenberger appeals the trial court’s summary judgment in favor of James Ellis. In two issues, Goodenberger claims the trial court erred by granting summary judgment and by granting Ellis’s objections to Goodenberger’s summary judgment evidence. In a cross-issue, Ellis claims the trial court abused its discretion by denying his request for attorney’s fees. We reverse the trial court’s judgment to the extent it granted summary judgment on easement by estoppel and remand that issue to the trial court for further proceedings. In all other respects, we…
