This appeal involves the construction of certain clauses of the will of Charlemagne Tower, late of Philadelphia, in the state of Pennsylvania, deceased, and relates especially to the disposition under the will of certain real estate situated in this state. The questions raised and to be considered are in respect to the validity of a certain trust created by the will, and by particularly whether the absolute power of alienation of the real estate in question is suspended for a period exceeding two lives in being.
