Affirming.

Steve Antonio, a Greek, was shot and killed by tbe appellant, Patrick O’Hara, in front of a bouse on Megowan street, in Lexington, on tbe afternoon of August 31, 1914.

Antonio and John Tbomas, another Greek, who were engag’ed in tbe restaurant business next door, were conversing with Sallie Holland and Lizzie Fraley, two of tbe inmates of tbe bouse.
