In September, 1876, the complainant, as an attorney at law, together with one Smith, entered into a written contract with the father of the defendants in this bill, by which they agreed to attend to the litigation that “ might arise or has arisen and now in court ” in three certain cases to which the father was a party, and perhaps also at that time some of the defendants may have been parties.
