Lotz, J. —

In this action the appellant sought to recover damages for personal injuries alleged to have been sustained on account of being thrown from appellee’s street car while in the act of alighting therefrom.

On behalf of the appellant there was evidence which tended to prove that at the time of the injury she was a large and corpulent person, of the age of sixty-five years, rather slow in her movements and actions. On the day of the injury she became a passenger on appellee’s street car. The car was drawn by mules and had no conductor other than the driver. As the car approached…
