The plaintiff, The First National Bank of Joplin, brought suit by attachment against the Swan Machinery Company and summoned the Joplin Welding and Machinery Company as garnishee. The garnishee answered and stated that it had in its possession $1360.48 but subject to the conditions of a certain contract, a copy of which was attached, and then alleged that one Joseph H.
