MORROW, Presiding Judge.

The offense is murder; punishment fixed at confinement in the penitentiary for a period of ten years.

Appellant and the deceased, Moon, had a business transaction in which Moon purchased' from the appellant a number of cattle and executed two cheeks in payment therefor. Moon had the cattle shipped to Fort Worth with the intent to sell them there. Finding the market unsatisfactory, he decided to ship them to Missouri. The checks not having been paid, appellant objected to Moon’s action, arid a quarrel and ill-feeling resulted. Appellant took possession of the cattle.…
