This suit was instituted in the Circuit Court of Shelby County by the defendant in error to recover total disability benefits under a policy issued to him by the plaintiff in error. We will hereafter refer to the parties as they appeared in the court below. There was a trial to a jury upon issues properly tendered in the pleadings, resulting in a verdict for the plaintiff. The trial judge overruled a motion for a new trial, whereupon an appeal was •prayed and granted to the Court of Appeals.
