TASHIMA, Circuit Judge:

Stephen Paul Dunifer (“Dunifer”) appeals from the district court’s summary judgment granting injunctive and declaratory relief in favor of the United States in this action brought under § 301 of the Communications Act of 1934, 47 U.S.C. § 301, which prohibits the operation of a radio station without a Federal Communications Commission (“FCC”) license. 1 Dunifer contends that the district court erred in ruling that he lacked standing to challenge the statutory validity and constitutionality of FCC licensing regulations as a defense to the government’s action.
