MEMORANDUM OPINION AND ORDER

OLIVER J. CARTER, Chief Judge.

The motions before the Court have raised questions concerning the effect of unification of the civil and admiralty practices. Plaintiff filed this action as an admiralty claim under Federal Rule of Civil Procedure 9(h) for defendant’s breach of an alleged contract of affreightment. Defendant has filed a permissive counterclaim under F.R.C.P. 13(b) requesting a jury and charging plaintiff with violation of the antitrust laws.
