DECISION ON THE MERITS

ROBSON, Chief Judge.

This action was brought by the United States to foreclose a federal tax lien filed against residential property located in Oak Park, Illinois. Pursuant to a Pretrial Order entered on March 14, 1974, this matter was submitted to the court for decision on the merits based *674on the briefs of the parties. For the reasons stated below, this court is of the opinion that judgment should be entered for the defendants: Gordon C. Borchardt; Mary A. Borchardt and Mid-America Bank of Chicago.
