The plaintiffs-appellants, Wilburn Young, Morris Delbridge and Sankey Stanton (hereinafter the plaintiffs), filed a complaint in the circuit court of Tazewell County asserting a class action against the defendant-appellee, Caterpillar, Inc. The complaint alleged the defendant breached individual contracts of the employment with the plaintiffs and all others members of the class they represented.
