BUFFINGTON, Circuit Judge.
In the/ lower court the Powell Knitting Company, herein called “plaintiff,” recovered a verdict against the Hebron Manufacturing Company, herein called “defendant,” for damages for alleged breach by the latter company of two contracts between them. Judgment was entered on the verdict, and defendant sued out this writ. The assignments of error raise three questions: First, was defendant justified in canceling the contracts ? Second, did the court lay down the correct rule of damages? And, third, should not the credibility of witnesses as to prices have been submitted…
