On the fourth day of April, 1934, James E. Herndon brought suit in the Court of Common Pleas of Baltimore City, wherein the declaration charged Salvatore Miciche and Salvatore Fertitta, individually, and as co-partners trading as Miciche Fruit Company, with the malicious prosecution of Herndon before a justice of the peace on a warrant sworn out on or about June 5th, 1931, and subsequently in the Criminal Court of Baltimore City, by which he was acquitted.
