OPINION ON SECOND MOTION FOR REHEARING

COHEN, Justice.

Our prior opinion is withdrawn, and this opinion is substituted in its stead. Appellant’s second motion for rehearing is overruled.

After finding appellant guilty of burglary of a building, the jury found one of two enhancement paragraphs to be true, and assessed punishment at life imprisonment.

This case requires us to decide 1) whether appellant had ineffective assistance of counsel at the punishment stage of his trial, and 2) if so, whether the remedy is an entirely new trial, as provided by law in effect on the date of the crime and the…
