Defendants in error, real estate brokers in the town of Fairview, Okla., constituting a copartnership, instituted suit in the county court of Major county, the purpose of which was to recover a com mission under a verbal contract with the plaintiff in error for the sale or exchange of certain real estate situated in said county.
