Defendant is charged by indictment No. 2012-0944 with one count of criminal possession of a weapon in the second degree, in violation of Penal Law § 265.03 (3), in connection with an incident occurring in the City of Rochester, County of Monroe, on November 28, 2012. The defendant brought a motion to suppress tangible and statement evidence. The tangible evidence at issue is a .45 caliber pistol. The People filed opposition papers.
