In this case, the Commonwealth filed a petition pursuant to G.L.c. 123A, §§1 et seq., alleging that the respondent Donald Sauve (“Sauve”) is a sexually dangerous person. After an earlier judicial finding of probable cause, Sauve waived in writing his right to a jury trial [D. 15], and the matter was tried to the court without a jury on August 25, 26, and 30, 2010. At the conclusion of all the evidence, the court reserved on Sauve’s oral motion for directed verdict. Post-trial briefs were requested by the court and filed by both parties.
