In accordance with the Unified Appeal Procedure, this Court granted the application for interim review to address pretrial issues in this case. Brandon Dwayne Smith is charged with malice murder and other crimes in Hall County, and the State is seeking the death penalty. Smith filed a challenge to the grand and traverse jury lists in Hall County, claiming that Hispanics are underrepresented in violation of the fair-cross-section requirement of the Sixth Amendment.
