CHRISTIAN, Judge.
The offense is murder; the punishment, confinement in the penitentiary for fifty years.
It was charged in the indictment, in substance, that appellant, with malice aforethought, killed Etienne Richard by shooting him with a gun.
The homicide occurred on the 5th day of February, 1937, on a tract of land appellant had leased for trapping purposes. Deceased and Albert Theriot had entered into an agreement with appellant whereby they were permitted to trap on said land.
