ORDER OF DISMISSAL

MELTON, District Judge.

This cause is before the Court on defendant’s Motion to Dismiss, filed herein on March 23, 1988. Plaintiffs responded with a memorandum in opposition to the motion, filed herein on April 6, 1988. For the reasons stated herein the motion will be granted.

Plaintiffs, David F. Scales, M.D. (“Scales”), and Physicians National Risk Retention Group, Inc. (“Physicians National”), initiated this action against defendant, Memorial Medical Center of Jacksonville, Inc.
