Thiele, J.:

This was an action to recover damages for personal injuries. A demurrer was sustained to the plaintiff’s evidence and he appeals.

In a preliminary way it may be stated that one J. S. Cohen was the owner of a building facing west on Kansas avenue in Topeka. The ground floor of that building was divided into three rooms. There was a cross partition which created a storage room to the rear of the building.
