On February 11, 1957 an accident occurred at the corner of Broadway and Hooper Street, in the Borough of Brooklyn, City of New York. At that time the plaintiff Ismail was riding as a passenger upon a motorcycle owned by one Hussein (not served in this action) and operated by the plaintiff Vurgun. It is the claim of the plaintiffs that the motorcycle was in collision with a truck of the Department of Sanitation of the City of New York, and that as a result of that collision, the motorcycle went out of control, struck another motor truck on the opposite side of the street and threw both…
