Error, to the Common Pleas of Blair county. This was an action on the case by Charles Rauch, a minor, by his father and next friend, against Lloyd & Hill. On the 9th day of July 1855, the plaintiff, Charles Rauch, a lad of about six or seven years of age, in company with another boy of about the same age, named Myers, went from the residence of his father, who resided on Juniata street, in the borough of Hollidaysburg, to a carpenter shop, a short distance from his father’s residence, for shavings. The plaintiff is a minor, who sues for an injury which he alleges was caused by the negligence of the servants of the defendants. On the morning of the 9th of July 1855, when he was about six or seven years of age, he was sent by his father, who resides on Juniata street, in Hollidaysburg, to a carpenter’s shop in the neighbourhood, for a basket of shavings.
