The above case is before me upon the motion of the plaintiff H. C. Railey to dismiss the Third Party Defendant, Pearce-Young-Angel Company, Inc. from the above cause of action upon the following grounds: “1. That plaintiff is an employee of Southern Railway Company and not Pearce-Young-Angel Company, Inc. 2. That Pearce-Young-Angel Company, Inc. is under no duty to furnish the plaintiff with a reasonably safe place to work. 3.
