RAMSEY, Judge.

Appellant was indicted by the grand jury of Ellis County on November 28th of last year for the theft of twenty-six sacks, alleged to be the property of one J. J. McQuatters, of the value of $2.60, and in another count with the offense of fraudulently receiving stolen property.

The testimony of the State includes circumstances sufficient, perhaps, to sustain the conviction if they stood alone. It was appellant’s contention that he bought these sacks from or through one Parson Frierson, a negro driver. This contention he supported by his own testimony as well as the evidence of…
