Plaintiff, J. C. Wyant, recovered judgment against defendant, Catherine Phillips, in the sum of $2,000.00 for personal injuries sustained by him when struck by an automobile belonging to her and operated by her husband, W. PI. Phillips.

The case was submitted to the court in lieu of a jury upon a stipulation of facts, following: The collision resulted from the negligent operation of the car by W. H. Phillips, who died before the institution of this action. The automobile had been given to Catherine Phillips by her father. Her husband, W. H. Phillips, paid the cost of its upkeep…
