On the 30th of August, 1830, the mother of the plaintiffs, acting as the administratrix of her deceased husband? presented her petition to the Court of Probates, representiii'g the estate as largely indebted, and as having no means of paying the debts, except by a sale of the property ; she, therefore, prayed for a family meeting, and a sale of the real and personal estate. The judge ordered a family meeting to assemble on that day, which was held.
