Appellant was engaged to place a smokestack on a building. The stack was one hundred feet long, four feet in diameter and weighed fifteen thousand pounds. It was to be raised from a horizontal position on the ground to a vertical one on tlie roof. For this purpose the defendant used a gin pole, 60 feet in length, made of piping of graduated sizes. It stood on two planks laid flat on the roof, close to where the smokestack was to rest. Guy lines attached to the top of the pole were fasténed at the other ends.
