This was an action in the nature of ejectment, brought by the Atchison, Topeka & Santa Fé Eailroad Company against Elizabeth Fearns, to recover the south half of the southeast quarter of section 21, in township 20 south, of range 8 east, in Chase county. Before the final trial of the case, Elizabeth Fearns died, and the action was revived against her heirs, Chaifies Fearns and Catherine Gleason.
