Appeal from judgment of the General Term of the Superior Court of the city of Kew York, affirming a judgment in favor of defendant, entered upon a decision of the court on trial at Special Term. Two instruments similar in form lie at the bottom of this controversy. They are in these words :

“ Bcccivcd of J. W. Jones by agreement, one thousand shares of St. Joe Lead Stock for which I have paid him $3.,000. The understanding is that I am to give said Jones one-half of whatever price the same is sold for, when sold over and above that sum.
