Appeal from a judgment for costs, entered in favor of the defendant and against the plaintiff in the Municipal Court of the city of Few York, twelfth district, borough of Manhattan.

The defendant having recovered at the second trial was, under the direction of this court in 51 Misc. Rep. 31, entitled to costs; hut the judgment rendered in his favor at the second trial having now-been reversed, his judgment for costs falls with that judgment.

Judgment reversed, without costs.

Judgment reversed, with costs.
